Windows 8 updates

I'm trying to sort out a laptop that has W8 on it. It can download updates but, when it restarts to apply them, it gets to 98% of the configuration process before failing and rolling back the updates. I've done the Troubleshooting - Windows update fixes, which appears to work when run as administrator but it doesn't stop the issue recurring straight away.

 

 

I gather that 8 is out of support and updating to 8.1 is a good course of action. Would it be possible to download an 8.1 disk image and install that over the top of the existing installation? If I were to do a fresh install of 8.1 to a replacement hard drive, what would I have to do to transfer the licence?
