Can't upgrade from Windows 8 to 8.1, is my license not genuine?

I just bought a new secondhand unit from a reputed shop with considerable good reviews online. I bought a toshiba satellite z930. I need to update to 8.1 because I can't install Sketchup and I can't install pretty much everything if I don't upgrade. I can't upgrade and update, I already restarted, it still won't update. Was I rigged? Is it not genuine or something?
