Installing os system after hard drive replacement

My hard drive in my laptop completely failed before I could back up anything. I bought and installed a new hard drive. I do not have a disc or product key for the Windows os system the laptop came with (Windows 8). Do I have to buy Windows again? And is it sold on disk or usb stick?
